General Terms and Conditions (GTC)

General Terms and Conditions (GTC) - “Herzog Wolfgang Studios” Landlord: iA Lukas Dörr, Herzog Wolfgang Straße 21a, 66482 Zweibrücken

1. Arrival from 3:00 p.m. / Departure by 11:00 a.m. Arrival and departure times also apply to individually agreed weekdays. Departure must be by 11:00 a.m. on the day of departure at the latest. Overstaying the departure time by more than 60 minutes will result in the charge for an additional night's stay. Other arrival and departure times can be individually agreed upon with the landlord. If the tenant does not arrive by 10:00 p.m. on the day of arrival, the contract is considered terminated after a period of notice of 48 hours without notification to the landlord. The landlord or their representative may then freely dispose of the property. A (pro rata) refund of the rent due to early departure is generally not possible.

2. Special requests and additional agreements are generally possible. They require written confirmation from the landlord. In the case of pets, the type and size must be stated.

3. Payment The rental agreement becomes effective upon receipt of the deposit into the landlord's account. The total rental price is due within eight days of receipt of the booking documents. If the payment deadlines are not met, the landlord may withdraw from the contract. Non-payment is considered a cancellation and entitles the tenant to re-rent. Additional charges for water, parking, waste disposal, and Wi-Fi are not charged.

4. Cancellation You may withdraw from the contract at any time. Cancellation must be made in writing. You can cancel free of charge up to 7 days before arrival. If you cancel within 7 days of arrival, you will pay the total price. If you do not arrive, you will pay the total price. If you cancel less than seven days before the start of the rental period, the full rental price is payable. The date of receipt of your cancellation notice is decisive. Any amounts already paid will be offset. If payment has already been made and an invoice has been issued, a cancellation fee of 5 euros will be due for a credit note. Any fees such as PayPal fees, unless they are non-refundable, are also non-refundable. You can provide a replacement person who will enter into your contract under the stated conditions. Written notification is sufficient.

5. Tenant's Obligations The tenant undertakes to treat the rented property (holiday apartment, inventory, and outdoor facilities) with care. If damage occurs to the holiday home and/or its inventory during the rental period, the tenant is obligated to report this immediately to the property management. Defects and damage discovered upon arrival must be reported immediately; otherwise, the tenant is liable for these damages. A reasonable period of time must be allowed to remedy damage and defects. Claims for complaints not reported immediately on site are excluded. Complaints received by the landlord only at the end of the stay or after vacating the holiday home are also excluded from compensation. In the event of any disruptions in service, the tenant is obligated to do everything reasonable within the scope of their legal obligations to help remedy the disruption and minimize any damage. On the day of departure, the tenant must remove personal belongings, dispose of household waste in the designated containers, and store clean and washed dishes in the kitchen cupboards.

6. Data Protection The tenant agrees that, within the scope of the contract concluded with him, necessary personal data may be stored, modified, and/or deleted. All personal data will be treated with absolute confidentiality. Further information on data protection can be found at: https://apartmentszw.de/de/dataPrivacy

7. Liability This advertisement was prepared to the best of our knowledge. We assume no liability for any impact on the rental property caused by force majeure, power and water outages, or severe weather. Likewise, we assume no liability for unforeseeable or unavoidable circumstances such as official orders, sudden construction work, or disruptions caused by natural or local conditions. However, the landlord will be happy to assist in resolving problems (where possible). The landlord assumes no liability for the use of the provided equipment. The tenant is solely responsible for their own travel to and from the property. The landlord is not liable for personal belongings in the event of theft or fire. The tenant is fully liable for any deliberate destruction or damage.

8. Final Provisions Photos and text on the website or in the flyer serve as a realistic description. Full conformity to the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g., furniture), provided they are of equivalent quality. Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that most closely reflects the economic and legal intent of the contracting parties. German law applies. The place of jurisdiction and performance is the landlord's place of residence.
